We at Hancom Inc. are grateful to have you here.
These Hancom Online Editing Terms of Service ("Terms") describe your rights and responsibilities when using Hancom Services as described below. Please carefully read before using Hancom's Services, as our Terms are different from the terms governing the service that may have directed you here.
Acceptance of the Terms
You must be of legal age to enter into a binding agreement in order to accept the Terms. If you do not agree to the Terms, do not use Hancom Services. You will accept the Terms by actually using the Hancom Services.
Description of Your Rights
We provide services for online office including Word, Cell, and Show ("Services"). You may use the Hancom Services for your personal and business use or for internal business purpose in the organization that you represent. You may connect to the Hancom Services using any Internet browser supported by the Hancom Services. You are responsible for obtaining access to the Internet and the equipment necessary to use the Hancom Services. You can create and edit content by accessing the Hancom Services and if you choose to do so, you can publish and share such content through any integrated third-party applications to the Hancom Services.
Code of Conduct
You are solely responsible for any information that you post, display or communicate through the Hancom Services. You agree not to use the Hancom Services for illegal purposes or for the transmission of material that is unlawful, defamatory, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, pornographic, obscene, or is otherwise objectionable, offends religious sentiments, promotes racism, contains viruses or malicious code, or that which infringes or may infringe intellectual property or other rights of another. In the event of misuses, Hancom is not responsible for any consequences.
Ownership of Content Created
You own the content created by you. Your use of the Hancom Services does not grant us a license to use, reproduce, adapt, modify, publish or distribute the content created by you. To clarify, we do not have any ownership and thus we do not have any responsibility for any content you create through the Hancom Services.
When you use the Hancom Services, you are providing your content to us directly. We are providing the Hancom Services directly to you and not as a subcontractor, agent, or vendor of the provider of any third party service you may use to access the Hancom Services. We will not access, process, or use your content for any purpose other than to provide you the Hancom Services. Additionally, we will store and retain your content only on a limited, temporary basis during your use of the Hancom Services for the relevant editing session only and solely for the purpose of providing you the Hancom Services.
Modification of Terms of Service
We may modify the Terms from time to time without a service announcement. If we intend to make significant changes to the Terms that affect your rights, they will be identified at least 30 days in advance on our website. It will be considered as an acknowledgement of the announcement as well as an acceptance of the modification, if you are still accessing the Hancom Services after the modification.
User Sign up Obligations
You do not need to sign up for an user account with us separately to use the Hancom Services. We provide the Hancom Services through an integration with other services that you use. By using the Hancom Services, you agree to these Terms, and thus you will be eligible to use the Hancom Services.
Organization Accounts and Administrators
When you sign up for an account for your organization you may specify one or more administrators. The administrators will have the right to configure the Hancom Services based on your requirements and manage end users in your organization account. If your organization account is created and configured on your behalf by a third party, it is likely that such third party has assumed administrator role for your organization. Make sure that you enter into a suitable agreement with such third party specifying such party's roles and restrictions as an administrator of your organization account. We do not have a responsibility in any matters related to your account with your organization or with a third party administrator of your organization.
Personal Information and Privacy
We do not share any personal information about you with any third party or access or use any of your personal information other than to provide the Hancom Services. We are not responsible for any loss or damage to you or to any third party incurred as a result of any unauthorized access and/or use of any user account that you opened with a third party.
If we receive any personal information about you, we will not retain, store, access, process, or use your personal information for any purpose other than to provide you the Hancom Services. Our use of your personal information will be in accordance with these Terms and applicable laws.
Thinkfree and Thinkfree logo are trademarks of Hancom, Inc. You agree not to display or use our trademarks without our prior permission.
Disclaimer of Warranties
THE HANCOM SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. WE MAKE NO WARRANTY THAT THE HANCOM SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. THERE MAY BE DELAYS, OMISSIONS, AND INTERRUPTIONS IN THE AVAILABILITY OF THE HANCOM SERVICE. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE HANCOM SERVICES IS AT YOUR SOLE RISK. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ANY USE OF THE HANCOM SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK. WE DO NOT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE HANCOM SERVICES OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE HANCOM SERVICES OR THAT DEFECTS IN ANY SOFTWARE, HARDWARE OR THE HANCOM SERVICES WILL BE CORRECTED. YOU UNDERSTAND AND AGREE THAT ANY USE YOU MAKE OF ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE HANCOM SERVICE IS AT YOUR OWN DISCRETION AND RISK, AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM US, OUR EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
LIMITATION OF LIABILITY
YOU AGREE THAT WE SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE HANCOM SERVICE, IN ANY RESPECT OF THE HANCOM SERVICES, WHETHER DIRECT OR INDIRECT.
You agree to defend, indemnify, and hold us, the provider of any integrated third party service and our respective affiliates, assigns, officers, employees, agents, directors and shareholders, harmless from and against any and all claims and liabilities, including reasonable attorneys' and experts' fees, related to or arising from:
- any breach by you of this Agreement;
- your use (or misuse) of the Hancom Services;
- all conduct and activities occurring using your account in any integrated service to the Hancom Services;
- any defamatory, libelous or illegal material(s) contained within your content or your information and data;
- any costs incurred on your behalf as a result of your failure to comply with local or International Law; and/or
- any of your own violations.
Laws Governing the Terms
This Agreement is governed by the laws of California, United States of America, excluding its conflicts of law provisions. However, any controversy or claim arising out of or relating to these Terms shall be first settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The decision of the arbitrator shall be final and unappealable. The arbitration shall be conducted in California.
You may choose to disable access to the Hancom Services by clicking in your setting or administrator page. By not using the Hancom Services, that would mean the termination of these Terms. However, these Terms during the period of your usage will remain alive and valid, and thus you will be obligated to these Terms for those uses. You may not have access to the Hancom Services if your user account with a third party service integrated with Hancom Services is closed by your will or against your will for any reason. In that case, you can re-use our Hancom Services by signing up on our website or other partner's services indicated in our website.
